Terms of Service

1. Acceptance of Terms

RhinoCert ("the Service") is operated by RHINOCERT LTD, a company registered in England and Wales with company number 17150289 (VAT No. GB517421019), whose registered office is at S08 The Genesis Centre, Innovation Way, Stoke-on-Trent, ST6 4BF ("we", "us", "our").

By accessing and using the Service, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

RhinoCert is a professional electrical certification platform that enables qualified electricians and electrical contractors to create, manage, and distribute electrical certificates including MEIWC (Minor Electrical Installation Works Certificate), EICR (Electrical Installation Condition Report), and EIC (Electrical Installation Certificate) documents.

The Service is designed for use by qualified electrical professionals and is intended to assist in creating BS7671-compliant electrical certificates for professional and commercial use.

3. User Eligibility and Professional Responsibility

By using this Service, you represent and warrant that:

  • You are a qualified electrical professional with appropriate certifications and competencies
  • You have the legal authority to perform electrical work and issue certificates in your jurisdiction
  • You will only use the Service for legitimate electrical certification purposes
  • You understand that you remain fully responsible for the accuracy and compliance of all certificates created
  • You will comply with all applicable electrical safety regulations and standards

You further represent and warrant that you are not located in, under the control of, or a national or resident of any country to which the United Kingdom, the European Union, or the United States maintains a comprehensive trade embargo, and that you are not listed on any UK, EU, or US government list of restricted or prohibited parties. You will not use, export, or re-export the Service in breach of any applicable export-control or sanctions law.

4. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

5. Subscription and Payment Terms

RhinoCert operates on a subscription-based model with the following terms:

  • Subscriptions are available on monthly, 6-monthly, or annual billing intervals
  • Payment is processed through our secure payment provider (Stripe). RhinoCert does not store your payment card details.
  • Subscriptions automatically renew at the end of each billing period unless cancelled
  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • Refunds are provided in accordance with our refund policy
  • Pricing may change with 30 days advance notice. You will be notified by email before any price change takes effect.
  • All prices are exclusive of VAT, which is added at checkout where applicable

6. Acceptable Use Policy

You agree not to use the Service to:

  • Create fraudulent or misleading electrical certificates
  • Impersonate another person or entity
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any unlawful or prohibited purpose

7. Intellectual Property Rights

7.1 Licence to Use the Service

Subject to your compliance with these Terms and payment of any subscription fees that apply, RhinoCert grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Service — including the RhinoCert mobile applications and web portal — for your own internal business or professional purposes as a UK electrician, Qualified Supervisor, or member of a company account registered with us.

This licence does not permit you to: (a) copy, modify, or create derivative works of the Service except where these Terms expressly allow it; (b) reverse engineer, decompile, disassemble, or attempt to derive the source code, except to the extent applicable law prohibits such restriction; (c) rent, lease, lend, sell, redistribute, sublicense, or commercially exploit the Service, or make it available to any third party outside your company account; (d) remove, alter, or obscure any copyright, trademark, or other proprietary notice; (e) use the Service to develop a competing product, scrape its content, or train any third-party machine-learning model; or (f) circumvent any technical limitation, access control, or usage restriction.

Your right to use the Service ends automatically if your subscription lapses, your account is suspended or terminated, or you materially breach these Terms.

7.2 Ownership of the Service and Your Content

The Service and its original content, features, and functionality are owned by RhinoCert and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of the content you create using the Service, including your electrical certificates and company data.

By uploading content to the Service (including photographs, observation images, certificates, and other materials), you grant RhinoCert a non-exclusive, perpetual, worldwide, royalty-free, sub-licensable licence to use, reproduce, modify, adapt, and create derivative works of such content for the purposes of operating, improving, and developing the Service, including training and improving our AI features such as AI Circuit Detection. You represent and warrant that you have all necessary rights and permissions to grant this licence.

7.3 Application Stores as Third-Party Beneficiaries

Where you have obtained the RhinoCert mobile application from the Apple App Store or Google Play, you acknowledge that Apple Inc. and Google LLC (and each of their respective subsidiaries) are third-party beneficiaries of these Terms in respect of your use of that application, and each has the right to enforce these Terms against you as such. RhinoCert, and not the application store operator, is solely responsible for the mobile application and its content; the operator of the application store has no obligation to provide maintenance, support, warranty, or product-claim handling in respect of the application.

8. Data Protection and Processing

This section constitutes a data processing agreement between you and RhinoCert for the purposes of Article 28 of the UK General Data Protection Regulation ("UK GDPR"). It applies to all personal data processed by RhinoCert on your behalf through the Service. Our Privacy Policy provides additional detail on how we collect, use, and protect information.

8.1 Roles and Responsibilities

For the purposes of UK data protection law:

  • You (the account holder) are the data controller for certificate data and any client or installation information entered into the Service. You determine the purposes and means of processing that data.
  • RhinoCert is the data processor for certificate data — we process it on your behalf and in accordance with your instructions as set out in these terms.
  • RhinoCert is the data controller for account registration data (your name, email, login credentials), billing data, and usage analytics.

8.2 Scope of Processing

RhinoCert processes the following categories of personal data on your behalf:

  • Certificate data: Information contained in electrical certificates you create, including client names, installation addresses, test results, and observations
  • Photographs: Images of installations, observations, and circuit boards uploaded through the Service
  • Signatures: Digital signatures captured for certificate completion

The categories of data subjects whose data may be processed include your clients, property owners, tenants, and other individuals whose details appear on electrical certificates.

8.3 Processing Instructions

RhinoCert shall process personal data only on your documented instructions, which are:

  • To provide the Service as described in these terms, including storing, retrieving, displaying, and generating PDFs from certificate data
  • To provide offline access to certificate data via local device storage
  • To sync certificate data between your devices and our cloud infrastructure
  • As otherwise instructed by you through your use of the Service

RhinoCert shall not process your certificate data for any other purpose, including marketing, profiling, or sale to third parties.

8.4 Security Measures

RhinoCert implements appropriate technical and organisational measures to protect personal data, including:

  • Encryption of data in transit (TLS) and at rest (AES-256)
  • Secure authentication with brute-force protection
  • Role-based access controls and company-level data isolation
  • Secure cloud infrastructure (Google Cloud Platform / Firebase)
  • Regular security assessments
  • Encrypted local storage on mobile devices

8.5 Sub-processors

You provide general authorisation for RhinoCert to engage sub-processors to assist in providing the Service. Our current sub-processors are:

  • Google Cloud Platform / Firebase (United States / EU) — hosting, database, authentication, file storage
  • Stripe (United States / EU) — payment processing
  • Resend (United States) — transactional email delivery
  • Vercel (United States) — web application hosting

We will notify you by email of any intended changes to our sub-processors, giving you the opportunity to object. Each sub-processor is bound by data protection obligations no less protective than those set out in these terms.

8.6 Data Breach Notification

In the event of a personal data breach affecting data we process on your behalf, RhinoCert shall:

  • Notify you without undue delay and in any event within 72 hours of becoming aware of the breach
  • Provide sufficient information to enable you to meet your obligations to report the breach to the Information Commissioner's Office (ICO) and affected individuals where required
  • Co-operate with you and take reasonable steps to assist in the investigation and mitigation of the breach

8.7 Data Subject Rights

Where we receive a request from one of your data subjects (for example, a homeowner asking about their data on a certificate), we will promptly notify you and shall not respond to the request directly unless instructed by you. We will provide reasonable assistance to help you fulfil your obligations to respond to data subject requests.

8.8 Data Deletion and Return

Upon termination of your account, or upon your written request, RhinoCert shall delete all certificate data processed on your behalf within 30 days, except where retention is required by law (for example, financial records required by UK tax law). You may export your certificate data as PDF documents at any time during your subscription.

8.9 International Transfers

Personal data processed on your behalf may be transferred to countries outside the United Kingdom, including the United States, where our sub-processors operate. Such transfers are made subject to appropriate safeguards, including Standard Contractual Clauses approved by the UK Secretary of State and applicable data transfer frameworks.

8.10 Audit

RhinoCert shall make available to you, on reasonable request, information necessary to demonstrate compliance with this section. You may, on reasonable notice and no more than once per year, request an audit of our data processing activities, provided that such audit does not unreasonably disrupt our operations and is subject to appropriate confidentiality obligations.

8.11 Confidentiality

RhinoCert ensures that persons authorised to process personal data on your behalf are subject to appropriate obligations of confidentiality.

9. AI Features and Automated Analysis

The Service may include AI-powered features, such as circuit board detection and automated data extraction. These features are provided as an assistive tool only. You acknowledge and agree that:

  • AI-generated content and analysis are provided "as is" without any warranty of accuracy
  • You bear full responsibility for reviewing, verifying, and validating all AI-generated outputs before using them in any certificate or professional document
  • AI features are not a substitute for professional judgement, inspection, or testing
  • RhinoCert accepts no liability for errors, omissions, or inaccuracies in AI-generated content

10. Delegated Signature and Mastering Authority

RhinoCert allows you to upload and store a digital representation of your handwritten signature ("Stored Signature") which the Service applies to certificates you create, review, or master. RhinoCert supports collaborative workflows in which multiple users within a single company account may contribute to the production of a single certificate.

Where your company account uses the review and approval workflow, or where role-based permissions (Owner, Qualified Supervisor, Electrician, or other roles defined within your account) authorise another user to master, approve, or sign off a certificate on which your Stored Signature appears, you acknowledge and agree that:

  • your Stored Signature may be applied by an authorised user within your company account without your direct action at the moment the certificate is mastered or signed;
  • this delegated signing functionality reflects established industry workflows for electrical certification and inspection — including single-signatory self-certification, multi-signatory approval, and reviewer-led sign-off — and operates only within the role permissions and review settings configured by your company's account administrator;
  • any application of your Stored Signature by an authorised user within your company account has the same legal and professional effect as if you had personally applied the signature;
  • you, together with the Owner or administrator of your company account, remain solely responsible for ensuring that role permissions, review settings, and self-certification controls are properly assigned, monitored, and revoked, and that members of your company account hold the qualifications appropriate to the actions they are permitted to perform;
  • RhinoCert maintains audit metadata indicating which user applied a Stored Signature, the role under which they did so, and the time it was applied, but you are solely responsible for reviewing that metadata and for compliance with your company's internal policies, your regulatory obligations under BS 7671 and other applicable standards, and your professional duties to scheme operators and clients.

RhinoCert accepts no liability for the unauthorised, mistaken, or improper application of a Stored Signature by users acting within the permissions configured by your company account.

11. Service Availability and Force Majeure

RhinoCert is delivered as a hosted online service together with mobile applications that include offline capability for certificate creation and editing. While we make reasonable efforts to maintain continuous availability, we do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. You acknowledge that:

  • routine maintenance, security updates, and platform upgrades may require temporary suspension of access, and we will give advance notice where reasonably practicable;
  • parts of the Service depend on third-party providers — including but not limited to Google LLC (Firebase, Cloud Functions) and Stripe Inc. (payments) — and outages affecting those providers may temporarily affect availability;
  • offline functionality is provided as a convenience and depends on local device storage; you remain responsible for ensuring that drafts and other data created offline are synchronised to the cloud once a connection is available;
  • RhinoCert maintains industry-standard backup and recovery procedures but does not guarantee restoration of any specific data, and we recommend that you retain independent copies of mastered certificates issued to clients.

RhinoCert is not liable for any failure or delay in performance arising from events outside its reasonable control, including acts of God, natural disasters, governmental action, war, civil unrest, cyber-attack, internet or telecommunications failure, third-party service outages, or labour disputes.

12. Professional Liability and Disclaimers

IMPORTANT: RhinoCert is a tool to assist in creating electrical certificates. You remain fully responsible for:

  • The accuracy of all information entered into certificates
  • Compliance with all applicable electrical regulations and standards
  • The quality and safety of electrical work performed
  • Professional liability for all certificates issued

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RHINOCERT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

RHINOCERT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO RHINOCERT IN THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

The following sections survive termination or expiry of these Terms: §7 (Intellectual Property Rights, excluding the licence to use the Service, which ends on termination), §8 (Data Protection and Processing) to the extent obligations continue under data-protection law, §9 (AI Features and Automated Analysis) in respect of liability disclaimers, §12 (Professional Liability and Disclaimers), §13 (Limitation of Liability), §16 (Governing Law), and any other provision that by its nature is intended to survive.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after such modifications constitutes acceptance of the updated terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
